These Terms of Use (“Terms”) govern your use of www.vanwilgens.com (the “Site”), operated by Van Wilgen’s Garden Center (“Van Wilgen’s,” “we,” “us,” or “our”). By using the Site or placing an order, you agree to these Terms. If you don’t agree, please don’t use the Site.

1. Changes to these Terms

We may update these Terms at any time. Changes take effect when posted, and we’ll update the effective date above. If you keep using the Site after changes are posted, you accept the updated Terms.

2. Using the Site

You may use the Site for lawful purposes, including browsing and buying our products and services. You agree not to: use the Site to break any law; try to gain unauthorized access to our systems; scrape or collect data from the Site without permission; interfere with the Site’s operation or security, including its bot protection; or upload harmful code.

3. Accounts

You must provide accurate information and keep your password secure. You’re responsible for activity on your account. Let us know right away if you think someone has used your account without permission.

4. Products, pricing, and availability

We work to keep product descriptions, images, availability, and prices accurate, but mistakes happen, especially with plant inventory that changes by season. We may correct pricing or listing errors, limit quantities, and cancel orders affected by an error, even after an order is placed. If we cancel an order you’ve already paid for, we’ll refund you in full for that order.

Some items ship directly from our growing partners rather than from our stores. Delivery timing and plant condition on arrival may vary for those items.

5. Gift cards

Gift cards are subject to the terms shown at the time of purchase and to applicable Connecticut law. Gift cards can’t be redeemed for cash except where required by law. Please treat gift card codes like cash. We aren’t responsible for lost or stolen gift cards, or for codes used without your permission.

6. Orders, delivery, and pickup

Local delivery pricing and availability depend on your location and the items ordered. In-store pickup availability is shown at checkout for eligible items. We aren’t responsible for delays caused by weather, carriers, or other events outside our reasonable control.

7. Returns and refunds

Return and refund terms for plants, hard goods, and gift cards are provided at the time of purchase or available on request. For questions about a specific order, contact us or visit any of our store locations.

8. Text messages

If you opt in to receive text messages from us, message frequency varies and message and data rates may apply. Reply STOP to any message to unsubscribe, or HELP for help. Consent to receive marketing texts is not required to make a purchase.

9. Reviews and content you submit

If you submit a review, photo, or other content to the Site, you give Van Wilgen’s a non-exclusive, royalty-free, worldwide license to display, reproduce, and use it on the Site and in our marketing. You’re responsible for what you post. Don’t submit content that’s false, defamatory, infringing, or unlawful. We may remove any submitted content at our discretion.

10. Intellectual property

The Site’s content, including text, graphics, logos, photos, and design, is owned by Van Wilgen’s or our licensors and is protected by copyright and trademark law. You may not copy, distribute, or create works based on Site content without our written permission, except for personal, non-commercial use.

11. Third-party services

The Site may link to or use third-party services, such as payment processing, social media, and maps. We don’t control and aren’t responsible for those services. Your use of them is subject to their own terms and policies.

12. Disclaimer

The Site and its content are provided “as is,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don’t promise the Site will be uninterrupted, error-free, or secure. Any plant guarantee is governed by our separate plant guarantee terms, not by these Terms.

13. Limitation of liability

To the fullest extent permitted by law, Van Wilgen’s isn’t liable for any indirect, incidental, special, or consequential damages arising from your use of the Site. Our total liability for any claim related to the Site or an order is limited to the amount you paid for the product or service involved.

14. Indemnification

You agree to indemnify and hold Van Wilgen’s harmless from claims, damages, and expenses, including reasonable attorneys’ fees, arising from your violation of these Terms or misuse of the Site.

15. Governing law

These Terms are governed by the laws of the State of Connecticut, without regard to conflict-of-law rules. Any dispute related to these Terms or the Site will be brought in the state or federal courts located in Connecticut, and you consent to jurisdiction there.

16. Severability

If any part of these Terms is found unenforceable, the rest stays in effect.
